The terms that govern purchases, digital delivery, account use and customer support.

These Terms and Conditions govern access to and use of the Softiyex websites and the purchase, delivery and use of digital software products offered by Softiyex.

By accessing our websites or placing an order, you agree to these Terms and Conditions. Please read them carefully before making a purchase. If you do not agree, you should not use the websites or place an order.

1. About Softiyex

Softiyex is an online business established in Spain that sells digitally delivered software products and related digital content.

The main product website is softiyex.com. Some orders may be securely processed through softiyx.com, the checkout domain used for certain Softiyex purchases. References to “Softiyex”, “we”, “us” or “our” include purchases completed through either domain.

2. Scope of These Terms

These Terms apply to visitors, customers, digital products, orders processed through softiyex.com or softiyx.com, digital delivery, activation and support connected with an order.

They apply together with the Refunds and Returns Policy, Privacy Policy, the product description and any licence information displayed before purchase.

If a product page contains specific information about a product, that clearly presented information applies to the relevant purchase. Nothing in these Terms limits mandatory consumer rights that cannot legally be excluded.

3. Eligibility to Purchase

To place an order, you must have legal capacity to enter a contract, provide complete and accurate checkout information, use a payment method that you are authorised to use and purchase only for lawful purposes.

Customers purchasing on behalf of a business confirm that they are authorised to bind that business to these Terms.

4. Digital Products

Depending on the selected product, delivery may include licence or activation keys, download links, installation files, instructions, account or access information, product documentation or access to a digital service.

No physical product will be shipped unless the product page expressly states otherwise. The product edition, operating system, licence duration, activation method, included features and limitations are shown on the relevant product page.

5. Product Information

We make reasonable efforts to ensure that product descriptions, images, compatibility information and prices are accurate.

Before purchasing, customers must review the product name and edition, supported operating systems, system requirements, device compatibility, language or regional restrictions, licence duration, permitted devices or users, delivery method, activation method and included or excluded features.

Product images are for identification and presentation. Interfaces, icons or packaging may change depending on the publisher, version or operating system. Minor presentation differences that do not affect essential functionality will not automatically make a product defective.

6. Compatibility

Customers are responsible for checking stated compatibility requirements before purchasing.

Softiyex is not responsible for compatibility problems caused by unsupported systems, devices that do not meet published requirements, incorrect product selection, third-party security or configuration settings, unauthorised modifications, or hardware, network or software problems outside Softiyex’s control.

Where compatibility information provided by Softiyex was materially incorrect or misleading, the customer may be entitled to an appropriate remedy.

7. Placing an Order

Products displayed on the website constitute an invitation to place an order. By completing checkout, the customer submits an offer to purchase under these Terms.

An automated confirmation acknowledges receipt of the order but does not necessarily mean final acceptance. The order is accepted when Softiyex confirms approval, begins digital delivery or provides the product, licence or access information.

Softiyex may reject or cancel an order before delivery where payment was not authorised, information appears incorrect, the product is unavailable, a displayed price contains an obvious error, fraud is suspected or the order violates these Terms or applicable law.

If an order is cancelled after payment and before delivery, the corresponding payment will be refunded.

8. Prices and Payment

The price displayed during checkout is the price payable for the selected product. Applicable taxes, currency information and additional charges will be displayed before the order is confirmed.

Available payment methods are shown during checkout. Payment may be processed by independent payment providers whose own terms and privacy notices may apply.

The customer confirms that payment information is accurate, the selected payment method is authorised and the transaction is not connected with fraudulent activity.

Unless clearly stated before purchase and expressly accepted, Softiyex products do not include recurring charges or automatic renewals.

9. Digital Delivery

Digital products are normally delivered to the email address entered during checkout or through another method described on the product page.

Customers must provide a valid email address and should check their inbox, spam, junk and promotional folders.

If an order has not arrived within the stated delivery period, contact support@softiyex.com. Softiyex may request the order number, payment email or other reasonable information needed to verify the order.

10. Licence and Permitted Use

Purchasing a product gives the customer only the usage rights described on the product page, licence information and applicable publisher terms.

The purchase does not transfer ownership of software, copyright, trademarks, source code, publisher systems or related intellectual property.

The customer may use the product only for lawful purposes, on the permitted number of devices or accounts, for the stated licence period and in accordance with activation instructions and publisher terms.

The customer must not resell or redistribute without authorisation, publish licence keys or access credentials, provide unauthorised access, bypass technical protection, copy or modify beyond what is legally permitted, or use the product for unlawful activity.

11. Account and Access Products

Where a product includes account access or login information, customers must keep credentials secure, follow supplied instructions, avoid sharing access, notify Softiyex of suspected unauthorised access and avoid prohibited changes.

Softiyex is not responsible for loss of access caused by credential sharing, unauthorised changes or use contrary to the instructions. This does not affect rights where access is lost because of a problem attributable to Softiyex.

12. Activation and Installation

Customers should follow the installation and activation instructions supplied with the order.

If an issue occurs, customers should provide their order number, checkout email, product name and version, operating system, device information, exact error message and relevant screenshots.

Softiyex may provide corrected instructions, compatibility checks, technical assistance, replacement activation information, replacement access or another suitable solution.

13. Updates and Online Features

The availability of updates, cloud services, artificial-intelligence features, online storage and publisher services depends on the specific product. These features are included only where expressly stated on the product page.

Unless otherwise specified, a purchase does not guarantee every future version, permanent access to third-party services, new cloud functionality or features introduced after purchase.

14. Right of Withdrawal

Consumers may have a statutory right to withdraw from a distance contract within the period established by applicable law.

For digital content not supplied on a physical medium, the withdrawal right may cease once digital delivery begins where the customer expressly consented to immediate supply and acknowledged that beginning delivery may result in loss of that right.

This does not remove rights where the product is defective, not delivered, incorrectly described or otherwise not in conformity with the contract.

15. Refunds, Replacements and Remedies

Refunds, replacements, price reductions and other remedies are governed by the Refunds and Returns Policy and applicable consumer law.

A remedy may be available where a product was not delivered, the wrong product was supplied, information was incomplete or incorrect, an activation method does not work, the product materially differs from its description or cannot be brought into conformity within a reasonable period.

Softiyex may first attempt to resolve an issue through support, corrected information or a replacement, provided this does not cause unreasonable inconvenience.

16. Customer Errors

Subject to mandatory consumer rights, Softiyex may refuse a discretionary refund where the correct product was delivered and activated, the wrong product or operating system was selected despite clear information, the device does not meet disclosed requirements, the customer changed their mind after immediate digital delivery began with the required consent, the product was shared or resold, reasonable information is withheld or the issue is outside Softiyex’s control.

Softiyex may nevertheless offer an exchange, store credit or another solution at its discretion.

17. Third-Party Software and Trademarks

Products sold by Softiyex may be developed or owned by third-party publishers. Product names, logos, brands and trademarks belong to their respective owners.

Use of third-party software may be subject to publisher licence terms, system requirements, acceptable-use rules, privacy policies, technical limitations and service availability.

Unless expressly stated, display or sale of a third-party product does not imply sponsorship, endorsement or partnership between Softiyex and the publisher.

18. Website Use

Visitors must not use the website unlawfully, access restricted systems, introduce harmful code, interfere with operation, collect data without authorisation, impersonate another person, place fraudulent orders, misuse promotional codes, obtain products without valid payment or reproduce substantial website content without permission.

Softiyex may restrict access, cancel orders or take appropriate action where misuse, fraud or unlawful activity is reasonably suspected.

19. Fraud and Payment Disputes

Softiyex may carry out reasonable order-verification and fraud-prevention checks. An order may be suspended or cancelled where there is reasonable evidence of unauthorised payment, identity misuse, manipulated payment information, abusive refund claims, unauthorised distribution, fraudulent chargebacks or licence misuse.

Customers are encouraged to contact Softiyex before opening a chargeback. This does not prevent a customer from contacting a payment provider or exercising applicable legal rights.

20. Intellectual Property

The Softiyex website, including its original text, design, structure, graphics and branding, is protected by applicable intellectual-property laws.

Without permission, users may not copy substantial parts of the website, reproduce Softiyex branding, create misleading copies, use Softiyex content commercially or present themselves as an authorised representative.

21. Availability of the Website

Softiyex aims to keep the websites available and functional but does not guarantee uninterrupted access. Access may be affected by maintenance, hosting problems, security incidents, technical faults, provider interruptions or circumstances outside reasonable control.

Confirmed orders and mandatory customer rights will not be removed merely because the website changes.

22. Limitation of Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

To the extent legally permitted, Softiyex is not responsible for losses caused solely by incorrect customer information, unsupported hardware or systems, unauthorised modifications, failure to follow instructions, third-party interruptions, customer disclosure of credentials, unlawful use or events outside reasonable control.

For business customers, and to the extent legally permitted, total contractual liability relating to an order will normally be limited to the amount paid for that order. This limitation does not apply to fraud, wilful misconduct, personal injury or liability that cannot legally be limited.

23. Data Protection

Personal data is processed in accordance with the Softiyex Privacy Policy and applicable data-protection law. Data may be processed to manage orders, deliver products, provide support, prevent fraud, handle payments, comply with legal obligations and manage disputes.

24. Force Majeure

Softiyex will not be responsible for delays or failures caused by circumstances outside reasonable control, including infrastructure failures, cyberattacks, widespread outages, government action, natural disasters, war, civil disturbance or interruptions affecting publishers or payment providers.

25. Changes to These Terms

Softiyex may update these Terms to reflect legal changes, website changes, new payment or delivery methods, security requirements, product changes or business operations.

The version applicable to an order will normally be the version available when the order was placed. Material changes will not retroactively remove rights already acquired under a completed order.

26. Severability

If any part of these Terms is found invalid or unenforceable, the remaining provisions continue to apply. The invalid provision will be interpreted or replaced only to the minimum extent necessary to make it lawful.

27. Governing Law

These Terms and contracts concluded through Softiyex are governed by Spanish law.

For consumers, this choice does not remove mandatory protections granted by the law of the country in which the consumer habitually resides. Consumer disputes may be brought before the courts having jurisdiction under applicable consumer law.

For business customers, disputes will be submitted to the competent Spanish courts unless another jurisdiction is required by law.

28. Entire Agreement

These Terms, together with the applicable product page, Refunds and Returns Policy and Privacy Policy, form the agreement between Softiyex and the customer regarding the relevant purchase.

A failure by Softiyex to enforce a provision immediately does not constitute a permanent waiver.
